Details and Restrictions of Image Reproduction
Services:
Service Charges:
All requests for image reproductions, regardless
of the intended purpose, will be assessed a service charge
to compensate
for the staff time required to process the request. Non-profit
organizations will be charged $15.00. Commercial organizations
will be charged $30.00.
Reproduction Restrictions:
Not all materials in the collection are publicly accessible
or reproducible. The physical condition of an item, donor
restrictions, and Federal regulations will determine restrictions
on access and reproductions.
According to the Hospital Insurance Portability & Accountability
Act (HIPAA), effective April 14th, 2003, Hospital employees
are not permitted to provide access to identifying information
of any patient - past, present, or future. As a result, the
Archivist is unable to provide access to, or reproductions
of, any images in which patients appear, unless the patients'
faces are blurred so as to be unrecognizable.
Delivery Method:
The Pennsylvania Hospital will not ship images via Federal
Express or any other express delivery service, UNLESS a prepaid
mailer is provided by the patron. Unless such special arrangements
are made, all shipments will be made via standard United States
postal service.
Requests for digital images will be sent via electronic mail,
unless disk service is requested. Requests for images to be
placed on floppy or Zip disks are subject to additional charges
(see fee schedule for details). The Hospital's Historic Collections
does not offer CD burning service at this time. A patron requesting
reproductions may opt to pick his/ her order up when it is
complete. In such cases, advance notification of the Archivist
of pick up date and time is required.
Time to Process Order:
Orders will be filled as staff time permits. Most reproductions
in print or slide format will be available within 2 weeks
of the date the order is processed. Orders for reproductions
of multiple images may require more time. Orders for reproductions
in print and slide form that are required in fewer than five
business days will be considered rush orders. Rush orders
are subject to additional charges.
Barring unforeseen circumstances, requests for digital images
delivered via e-mail will be processed within 3 business days
of receiving payment. Requests for digital images to be saved
to disk and delivered via post mail may require additional
time.
The Pennsylvania Hospital reserves the right to decline reproduction
requests if the amount of staff time required to do the work
is deemed to be too extensive.
Published or Exhibited Images:
All patrons wishing to publish or exhibit an image from the
Pennsylvania Hospital's Historic Collections must complete
a Permission to Publish and/or Exhibit Materials from the
Pennsylvania Hospital Historic Collections form and agree
to all terms specified therein. Non-exclusive rights will
be granted on a one-time only basis. Subsequent uses of Pennsylvania
Hospital images will require additional permission and may
be subject to additional use fees.
As specified in the Photographic Services Fee Schedule, a
$50.00 fee will be charged for each image used for commercial
purposes. A $100.00 fee will be charged for each image reproduced
as cover art for commercial purposes. (These fees do not apply
to images used for official Pennsylvania Hospital purposes
or to images used for non-profit purposes.)
Copyright Restrictions and Warning:
The copyright
law of the United States (Title 17, United States Code) governs
the making of photocopies and other reproductions
of copyrighted material. Under certain conditions specified
in the law, libraries and archives are authorized to furnish
a photocopy or other reproduction. One of the specified conditions
is that the photocopy or other reproduction is not to be "used
for any purpose other than private study, scholarship or research."
If a user makes a request for, or later uses, a photocopy
or reproduction for purposes in excess of "fair use," that
user may be liable for copyright infringement. This institution
reserves the right to refuse to accept a copying order if,
in its judgment, fulfillment of the order would involve violation
of copyright law.
Reproductions of materials in the Pennsylvania Hospital Historic
Collections are provided as a service to expedite research
and lessen wear on image/ documents, and are made solely for
the personal use of the individual researcher requesting them.
Reproductions may not be transferred to another individual
or organization, deposited at another institution, or reduplicated
without prior permission of the Pennsylvania Hospital. Duplication
by the Hospital in no way transfers either the copyright or
the property right. Similarly, duplication by the Hospital
does not constitute permission to publish, or to display materials,
without the express written consent of the Pennsylvania Hospital
Archivist via a signed Permission to Publish and/or Exhibit
Materials form, and the payment of use fees where applicable.
Once you have read and are willing to
comply with the aforementioned Details and Restrictions
of Image Reproduction Services, you
will be asked to read, complete, and sign a Permission
to Publish and/or Exhibit Materials From the Pennsylvania
Hospital Historic Collections Form.
